By accessing or using DatabØx products, the Datachain Rope network, or any services provided by Datachain Foundation SAS ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services.

2. Description of Services

We provide hardware appliances (DatabØx) and access to the Datachain Rope decentralized network for data storage, processing, and digital asset management. Our services enable users to maintain sovereignty over their digital information.

3. User Responsibilities

You agree to:

• Provide accurate information during registration and purchase
• Maintain the security of your account credentials and encryption keys
• Use the services in compliance with all applicable laws
• Not use the services for illegal activities or to harm others
• Not attempt to reverse engineer, modify, or tamper with hardware or software
• Not use the services to distribute malware or conduct cyberattacks

4. Hardware Purchase Terms

4.1 Orders and Payment

All orders are subject to acceptance and availability. Prices are subject to change without notice. Payment must be received in full before shipment.

4.2 Shipping and Delivery

Shipping times are estimates only. We are not liable for delays caused by shipping carriers or customs processing.

4.3 Returns and Refunds

Unopened products may be returned within 30 days of delivery for a full refund. Opened products may be returned within 14 days if defective. Custom configurations are non-refundable.

5. Warranty

DatabØx hardware comes with a 5-year limited warranty covering manufacturing defects. The warranty does not cover damage from misuse, unauthorized modifications, or acts of nature.

6. Network Participation

Participation in the Datachain Rope network is subject to network rules and consensus mechanisms. Rewards are distributed according to network protocols and may vary based on network conditions and your device's contribution.

7. Intellectual Property

All intellectual property rights in our products and services remain our property or that of our licensors. You receive a limited license to use the software as provided. Open source components are governed by their respective licenses.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, PROFITS, OR GOODWILL. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID FOR THE PRODUCT OR SERVICE.

9. Disclaimer of Warranties

SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

10. Termination

We may terminate or suspend your access to services immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

11. Governing Law

These Terms shall be governed by the laws of France, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Paris, France.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes through our website or via email. Continued use after changes constitutes acceptance.
